SHOULD THERE BE SOMETHING CALLED SUPREME LAW?


The constitution of most countries is regarded as the Supreme Law of that land, and in often times, very rigid in amendment. This is mainly because it is believed that the constitution is ultimately going to protect the interest of the people and avoid excessive use of powers by the government.

I was thinking a lot yesterday and I asked myself, should there be something called as SUPREME LAW when it was written by men and can hence, be unwritten by them?

If a writing which becomes a law further becomes supreme, aren't the writers more supreme and hence should live above it?

These questions popped into me when I realised how much things had changed and is still in motion, how much each younger generation wants to do better than the former, how the human mind is getting more cruel, and yet weak, how the laws should change too, to meet these trends. When the Supreme law of a land continues to remain supreme and unchanged, the effect of it on these changes points us all down to where it all began, the writing!

Placing such premuim on the constitution only gives so much powers to the government, and on the other hand, ceases the key to a proper lively environment. It also clearly defines that the legislature dare not interfere, and the judicairy ought to protect it as the final arbiter, but then, in the interest of whom is all of these?

I had come accross certain cases where the Honourable court could clearly pass new and effective judgements, but they stick to the law of precedent, not because the old judgements are wrong, but there has got to be a little change as no two cases are exactly the same, for the main reason that the basic structure of the constitution cannot be tampered with. What is written can be unwritten!

There has to be certain values placed on the laws made but it must not be valued so much as to destroy the ones it was meant to protect. There shouldn't be something called as SUPREME LAW, there should be something called as TRUE LAW.

Still thinking....what should TRUE LAW be???
